Hungary Introduces Stricter Oversight Rules for Court Bailiffs

Hungary's Regulated Activities Supervisory Authority (SZTFH) has issued new regulations establishing a more transparent inspection framework for independent court bailiffs, granting enhanced oversight powers to both SZTFH and the Hungarian Chamber of Court Bailiffs (MBVK).

Key Regulatory ChangesThe new decree introduces several significant modifications to the existing supervisory framework:

Mandatory comprehensive audits must now be conducted at least every three years following the initial inspectionEnhanced financial scrutiny with particular focus on cash handling procedures and related record-keepingMandatory inspections required when a bailiff takes over cases from a discontinued positionStandardized inspection topics to be defined by the SZTFH president for all comprehensive and substitution auditsStricter Enforcement MeasuresThe regulation takes a harder stance against non-compliant bailiffs. A new provision allows for disciplinary complaints to be filed in any case where a bailiff refuses to cooperate with inspections despite formal requests, or fails to meet other obligations specified in the decree.

The SZTFH president will designate mandatory inspection topics primarily focused on maintaining public trust in the official system, requiring inspection leaders and auditors to pay heightened attention during relevant examinations.

These changes reflect practical experience gained over recent years and aim to strengthen public confidence in the judicial enforcement system through more effective regulatory oversight.
